The records behind this warning
The account published on this site is drawn from documents. Those documents are not published here, but they are available to genuinely interested parties on request.
-
The Information Memorandum
See clause 2The document provided in August 2020 setting out the terms of the development, the proposed fees and the profit split arrangement.
-
Accounting and bank records
See clause 7Records of the project’s Xero accounting system and its Westpac bank account, to which the investors held access until that access was cancelled.
-
The court file
See clause 13Material from the proceedings commenced in September 2022 in which the investors alleged, amongst other things, equitable fraud by the directors.
-
Bankruptcy records
See clause 21The sequestration order made on 6 March 2024, and the debtor’s petition presented on 22 March 2024. Both are recorded on the National Personal Insolvency Index maintained by AFSA and can be searched independently.
Some of it you can check yourself
The bankruptcies are a matter of public record and do not depend on anything published here. Anyone can search the National Personal Insolvency Index directly through AFSA for a fee of $15.
Company and directorship history is similarly public through ASIC, and occupational licences can be checked through the relevant registers at no cost.
We would encourage you to run those searches yourself rather than take anything on this site at face value.
How to make a request
Email [email protected] and tell us:
- Who you are, and how to reach you.
- Why you are asking — for example, that you are considering a transaction, or that you have had dealings of your own.
- Which records you are interested in.
Requests are considered individually. Some material may be subject to restrictions on its use or disclosure, and anything provided is provided on that basis.
